Federal Legal Status of Hemp
Under the Agriculture Improvement Act of 2018 (Public Law 115-334), commonly referred to as the 2018 Farm Bill, Congress removed “hemp” from the definition of marijuana under the Controlled Substances Act (“CSA”), 21 U.S.C. § 801 et seq.
Statutory Definition of Hemp
Section 297A of the Agricultural Marketing Act of 1946 (as amended by the 2018 Farm Bill) defines hemp as:
“The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”
Products offered by Rosada Wellness are derived from hemp that meets this federal definition and contain no more than 0.3% delta-9 tetrahydrocannabinol (Δ9-THC) on a dry weight basis.
Distinction Between Hemp and Marijuana
Although hemp and marijuana both originate from the plant species Cannabis sativa L., federal law distinguishes them based on delta-9 THC concentration.
Marijuana remains classified as a Schedule I controlled substance under the CSA.
Hemp, as defined above, is not a controlled substance under federal law when produced pursuant to applicable regulations.
Rosada Wellness products are hemp-derived and are not marijuana.
Interstate Commerce Protections
Section 10114 of the 2018 Farm Bill expressly prohibits states and Indian tribes from interfering with the interstate transportation or shipment of legally produced hemp.

All applicable products are sourced from hemp cultivated under federally compliant programs.
Products are laboratory tested for cannabinoid content, including confirmation of Δ9-THC compliance.

The U.S. Food and Drug Administration (FDA) has not evaluated statements regarding hemp-derived cannabinoid products unless otherwise expressly stated.
